El 8 de noviembre de 2011, estudiantes de la Universidad de California (UC) en la ciudad de Davis (EEUU) ocuparon noviolentamente una acera peatonal, como parte de una campaña desplegada en todo el sistema de sedes de la UC, para protestar contra un alza en los costos de matrícula y el corte de fondos a las universidades. Unos días antes, la policía había usado sus bastones contra estudiantes y personal de la facultad en otro campus, la Universidad de California en Berkeley, y había destrozado un campamento similar al desplegado en la UC Davis.
Los videos muestran a la policía del campus UC Davis y a la policía local usando equipos antimotines y aparentemente portando pistolas de paintball, capaces de disparar proyectiles de aerosol de pimienta. Cuando los estudiantes se sentaron con sus brazos en cadena y rehusaron moverse de la acera, el teniente de la policía del campus, John Pike, los roció a corta distancia con una dosis de aerosol pimienta de alta concentración, enfrente de una gran multitud de estudiantes que observaban el hecho. Ésta es la paradoja de la represión que nosotros y nuestros colegas exploramos en un volumen titulado La paradoja de la represión y los movimientos noviolentos (publicado, en inglés, por Syracuse University Press, 2018). Es una dinámica fundamental de la resistencia civil noviolenta también llamada “acto contraproducente” y “jiu-jitsu político.” En los ejemplos más claros de esta paradoja, cuando las autoridades, élites, o contramanifestantes usan la fuerza física para tratar de desmovilizar a activistas noviolentos, las imágenes de las golpizas, arrestos, ataques con perros, mangueras de agua y asesinatos, pueden generar una indignación moral que puede conducir a un incremento de la movilización y el apoyo a los activistas, y algunas veces incluso a la deserción de simpatizantes de los oponentes hacia el movimiento. Cuando los activistas noviolentos mantienen su postura noviolenta, elevan el contraste entre la violencia de sus oponentes y sus propias acciones, incrementando la posibilidad de que la represión sea contraproducente y de que las autoridades pierdan legitimidad.
El incidente del aerosol pimienta en UC Davis ilustra la paradoja de la represión de varias maneras. En primer lugar, los estudiantes sentados en la acera de su propio campus demostraban claramente que no representaban ninguna amenaza para la policía o para las otras personas a su alrededor. Así que, cuando el Teniente Pike utilizó el aerosol pimienta para incapacitarlos, se lanzó una petición llamando a la renuncia de la Rectora de la Universidad, la cual consiguió cerca de 115,000 firmas. Los estudiantes rociados con el aerosol pimienta demandaron a la universidad y ganaron una disputa federal con un acuerdo por la suma de un millón de dólares, junto con una disculpa escrita de la Rectora Linda P.B. Katehi.
Este incidente también ilustra el manejo de la represión, los esfuerzos de los activistas noviolentos para incrementar la posibilidad de que las medidas represivas sean contraproducentes para quienes las ejecutan. El usar métodos de intervención noviolenta al ocupar la acera fue quizás el primer acto estratégico de anticipar la represión y entonces, una vez que el oficial de seguridad del campus atacó a los estudiantes, los activistas en línea trabajaron para manejar y enmarcar el evento de forma tal que maximizara su alcance. En un ejemplo fascinante de activismo cultural, los memes visuales proliferaron a través del Internet. Las imágenes del Teniente Pike superpuestas sobre la de los estudiantes mostraron la acción policial como irresponsable, implicando que fue absurda, desmedida, y anti estadounidense.
Cultivar el efecto del acto contraproducente revela que la represión es una interacción poderosa. Los activistas noviolentos pueden tomar decisiones estratégicas que los preparen para la represión, pero también moldear el impacto de la represión con sus propias decisiones tácticas. El video del evento muestra la indignación inmediata de los estudiantes que permanecían como espectadores, quienes gritaron consignas como “¡qué vergüenza!” y “¿a quién sirves, a quién proteges?”, enmarcando el evento como una violación del contrato social.
Pero incluso un acto estratégico más notable de manejo de la represión tuvo lugar a medida que la confrontación se fue desarrollando. Cuando la policía y los oficiales de seguridad arrestaron a los estudiantes, la ira de la multitud creció. Los oficiales de policía, en desventaja numérica, se tornaron visiblemente nerviosos mientras trataban de apartarse de la multitud que los rodeaba por tres lados. Formaron un círculo espalda contra espalda, y algunos comenzaron a levantar sus armas lentamente. La multitud comenzó a gritar con más fuerza, y se podía sentir la posibilidad creciente de una confrontación. ¿Podría un oficial de la policía entrar en pánico y apretar el gatillo? ¿Usaría el Teniente Pike sus cartuchos de aerosol pimienta otra vez? ¿Lanzaría alguien en la multitud una botella de agua y le daría a la policía la justificación para usar más fuerza física?
Lo que había comenzado como una acción estratégica noviolenta pudo haber derivado en una confrontación violenta. Si la policía hubiera sido atacada o provocada, el importante contraste entre la policía y los estudiantes se hubiera podido perder. La protesta noviolenta de los estudiantes en la acera se hubiera podido reformular como una acción de una turba peligrosa, jugando con las sensibilidades del público general acerca de la ley y el orden. La posibilidad de que todo se derrumbara parecía real. Hasta que un líder reorganizó brillantemente a la multitud y reafirmó claramente la disciplina noviolenta.
En el minuto 6 con 12 segundos del video del evento, se escucha a alguien gritar “¡prueba de micrófono!”, enfocando la atención de la multitud y llamándoles a participar en un sistema de amplificación humana, en el cual una muchedumbre repite lo que dice el orador, para que todo el mundo pueda oírlo. El orador (fuera de cámara) le grita a la policía, “Estamos dispuestos a brindarles un breve momento de paz. Pueden tomar sus armas y a nuestros amigos, e irse. Por favor, no regresen”. Entonces, la multitud corea, “¡Pueden irse! ¡Pueden irse!” La multitud finalmente deja sola a la policía, que luce apretujada, ligeramente desconcertada e insegura, despojada de la clase de confrontación para la cual han sido diseñados su entrenamiento, sus escudos y sus armas. En lugar de que la policía dirija la situación como fuerza legítima de la ley y el orden, de pronto son los estudiantes quienes le dan permiso a la policía para que se retire, reafirmando su legitimidad como estudiantes en su propio campus, gritando “¿De quién es el patio? ¡Nuestro patio!”
Los activistas estudiantiles noviolentos en UC Davis escogieron permanecer noviolentos de cara a la represión. Su respuesta disciplinada a la agresión con aerosol de pimienta ayudó a asegurar que las acciones de la policía pudiesen ser claramente interpretadas como desproporcionadas, desafiando así la legitimidad de la policía e incluso la de los administradores de la universidad, tal y como se reportó en la prensa. Cuando la acción de la policía y la ira de la muchedumbre amenazaron con provocar una confrontación violenta, que potencialmente podría justificar una mayor represión, alguien dio el paso al frente para manejar la represión en tiempo real y preservar el marco de fuerza excesiva por parte de la policía, situación que los activistas en internet sacaron provecho en los días y semanas que siguieron al incidente.
Las instancias en las cuales autoridades sobrepasan los límites de su legitimidad y usan fuerza excesiva son comunes en los Estados Unidos y alrededor del mundo. La habilidad de los activistas noviolentos de prepararse para la represión y cultivar la paradoja de la represión a través de un planeamiento cuidadoso y creativo resulta un tanto menospreciada.
